As of January 1, 2004 the application of the Personal Information Protection and Electronic Documents Act (the "Act") extends to the collection, use or disclosure of personal information in the course of any commercial activity within a province. What happens if I don't establish polices and procedures to handle personal information? In Canada, the Privacy Commissioner can audit a Corporation's personal information management practices if he has reasonable grounds to believe that a Corporation is not adhering to the Act. Furthermore, the Privacy Commissioner will investigate any complaints and may refer the complaint to the Federal Court of Canada. How does this affect me? If your web site is interactive in its communications with prospects and customers, chances are you are collecting "personal information" from them such as their email address. You may now have a legal obligation to protect that information on their behalf. At Snap Design, we take security seriously and many measures are in place to protect any data collected through your web site and stored on our servers. Our staff and technicians have all signed non-disclosure agreements and are well aware of the need to keep your information confidential. Maintaining the confidentiality of user information once you've received it, and refraining from its use in a manner to which the user has not consented, has become a legal obligation that we encourage you to discuss with your legal counsel. This only affects information collected by my website, right? Wrong. It extends to all the information about individuals that you receive and store in the course of your day-to-day business. Should I have a Privacy Policy statement on my web site? People have many concerns about giving up personal information, including concerns about identity theft and/or misuse of their email addresses. They may be concerned, for example, about getting unwanted spam or the possibility of their personal information being sold to third parties. They'll want to know what you will and won't do with any information they give you. Your published Privacy Policy can give them more confidence about getting in touch with you through your web site, thus raising its value. Having informed the users of your web site what you will do with their information may also protect you from harassing claims. Will you write our Privacy Policy for us? This is a job for you and your legal counsel. Is it expensive to publish our Privacy Policy on our web site? Not at all.
